Legal issues in naturism

Across the globe there are a variety of issues of legality arise regarding public nudity, naturism and nudism, or clothes free living. Laws regarding nudity whether in the privacy of a home or in public restrict or prohibit the practice of naturism.

The Naturist Action Committee does advocacy work in North America and the U.K. addressing naturist legal issues.

Laws regard public nudity in United States nudity laws differ from state to state. Many states prohibit showing genitalia in public, while others allow simple nudity.There is no law prohibiting public nudity on Federal lands, however nudity is not protected under federal law. Local ordinaces and laws supersede any Federal allowances. ² Understanding Nudity Laws

There have been several seminal legal cases related to the legality of public or social nudity.

In California public nudity itself is not a crime. Legality of public nudity and criminal penalties are governed by local ordinances. Enforcement of state and local nudity laws is uneven. Some state and local officials have developed loopholes to allow for some naturist practice. ³ Southern California Naturist Association Information Center

In Vermont public nudity is an offense when accompanied by lewd behavior. ⁴ Understanding Nudity Laws

In parts of some of the U.S. like Arkansas it is illegal to be visibly nude in your own house if you can be seen from outside. ⁵Unconstitutional Arkansas.

Brazil got its first legal nude beach in 2014. ⁶ Rio de Janeiro, known for its raunchy Carnival celebrations and near-naked Samba dancers, has finally legalised its first nudist beach.

In the United Kingdom legal issues regarding public nudity are guided by the College of Policing document. British Naturism provides a resource on Policing Public Nudity

No cases have succeeded under this Act nor under under Section 5 of The Public Order Act for over 5 years.  Parliament, CPS and the courts do not consider nakedness per se to be disorderly conduct.  Further information is on the CPS web site – https://www.cps.gov.uk/legal/l_to_o/nudity_in_public/#a08

Danish law does not have any explicit prohibition against public nudity. ⁷NUDITY IN DENMARK: THE NAKED TRUTH Behavior that is considered offensive to bystanders is prohibited. In practice public nudity outside of beaches and saunas is not common.

The Danish naturist organization cites this law:

Executive order Chapter 2. Safeguarding public order etc. § 3 pieces. 2. It is forbidden to display indecent or objectionable behavior that is likely to offend others or arouse public outrage. PCS. 4. If they are committed in subsection The actions mentioned in 1 and 2 in places to which there is no general access, and which cause disturbances to public order, the police can order that they be brought to an end.

Several German cities allow nudity in public designated spaces.

The Spanish courts have consistently ruled in favor of the legality of nudity in public places. This despite efforts to restrain or limit nudity though local ordinances. See below.

Public nudity is generally prohibited in most Asian countries except for religious or traditional ceremony. The religious  practice of the Sadhus and Digambara and the Kumbha Meh festival in India are examples
